Initially sold by Aearo Technologies, Inc., the dual-ended Combat Arms Earplugs, Version 2 (CAEv2) first became available in 2003. They were a promising piece of gear for our troops. One end of the devices was marketed as being capable of preventing hearing damage while still allowing troops the ability to hear what was happening in the field.
Unfortunately, these earplugs contained a critical flaw. According to the Department of Justice, the CAEv2 was “too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals.” This was part of the argument that the DOJ made against 3M Company in a False Claims Act suit that resulted in a $9.1 million settlement.
The FCA lawsuit alleged that 3M Company, which acquired Aearo Technologies, Inc. in 2008, knew about the defects and failed to disclose the product’s deficiencies to the military. Now, hundreds or more of servicemembers are suffering extensive hearing loss because of 3M Company’s negligence.

SIGNS AND CONSEQUENCES OF HEARING LOSS/
